Terms of Service

These terms are a binding agreement. Please read them before using Emboss. This page is provided for transparency and is not legal advice.

1. Acceptance of these terms

Emboss is operated by Three Poplars LLC, doing business as "Emboss" ("Emboss", "we", "us", or "our"). By creating an account, accessing, or using our website, API, or applications (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Emboss detects and fills fields in PDF forms through an API and web app. We may add, change, or discontinue features at any time.

3. Accounts and eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Service. You agree to provide accurate registration information, to keep your account credentials and API keys secure, and you are responsible for all activity that occurs under your account or keys.

4. Acceptable use

You agree not to: upload content you do not have the right to use; use the Service for unlawful, infringing, or harmful purposes; upload malware; attempt to abuse, overload, scrape, reverse-engineer, or circumvent the Service or its usage limits; or use the Service to violate the privacy or rights of others. You must respect applicable rate limits.

5. Your content

You retain ownership of the documents and data you upload and the outputs generated for you ("Your Content"). You grant Emboss a limited, worldwide, non-exclusive license to host, store, process, and transmit Your Content solely to operate and provide the Service to you — including transmitting it to third-party service providers that perform processing on our behalf (see the Privacy Policy). You represent that you have all rights necessary to upload Your Content and to authorize this processing, and you are responsible for any personal, sensitive, or regulated data you submit.

6. Automated and AI processing; accuracy

The Service uses automated and artificial-intelligence methods to detect and fill form fields. Output may contain errors and is not guaranteed to be accurate or complete. You are solely responsible for reviewing and verifying any filled form before relying on it or submitting it to any third party. Emboss is not responsible for the consequences of using unreviewed output.

7. Plans, fees, and billing

The Service is offered on usage-based pricing. Fees are presented at the time of purchase or use. Except where required by law or expressly stated (such as free-tier credits), fees are non-refundable. We may change pricing prospectively with reasonable notice. You are responsible for any applicable taxes.

8. Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability and may perform maintenance or make changes at any time.

9. Disclaimers

To the maximum extent permitted by law, the Service and all output are provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, Emboss and Three Poplars LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Emboss and Three Poplars LLC from any claims, damages, or expenses arising out of Your Content or your misuse of the Service.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these terms or to protect the Service. On termination, your right to use the Service ends and Your Content is handled as described in the Privacy Policy.

13. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Kentucky.

14. Changes to these terms

We may update these terms from time to time. We will update the "Last updated" date above, and for material changes we will provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance.
